An interesting decision has been issued in Mark Nabuyumbu Barasa v Director of Public Prosecutions & 2 Others (ELRC Petition No. E033 of 2026),where Justice Dr. Jacob Gakeri nullified a promotion process after the Respondents failed to explain why the Petitioner was excluded from a published shortlist of candidates expecting internal promotions. The Court held that public institutions must conduct their recruitments in full adherence to constitutional imperatives governing public service. In so doing, they must demonstrate that merit was an actual consideration in the recruitment process. The court declared the resultant appointments a nulity having flowed from a process characterized by procedural impropriety. Could the consequences of this decision be that public institutions would henceforth be required to demonstrate transparency and propriety of recruitments?
