WHY PPPs WILL NOT WORK IN UGANDA Twelve years, zero deals. Kenya did it in one quarter. The scoreboard Parliament passed the Public Private Partnerships Act in 2014. The President assented to it in August 2015. Twelve years later, Uganda has not taken a single project from that Act to financial close. That is not my opinion. The World Bank's own readiness diagnostic for Uganda recorded that, since the Act, no project had reached financial close, with the Kampala–Jinja Expressway the only one anywhere near ready. That was in 2020. In 2026 the PPP Unit's front page is still advertising for consultants on the same expressway. The road was first costed at USD 1.55 billion in 2018. Not one metre of it has been built by a private concessionaire. Now look across the border. One quarter in Kenya In May 2026 the idea of an East African refinery was still being argued over, with Tanga in Tanzania floated as the site. Weeks later, Dangote Group announced it had agreed with Kenya to build it in Lamu. On 30 September 2026, Aliko Dangote and President Ruto broke ground on a USD 16 billion plant designed to refine 700,000 barrels a day. About 110 pieces of equipment were already on site, with roughly 400 more due in the coming weeks. Dangote has committed to commissioning the refinery within 40 months, and Ruto told him publicly that Kenyans will hold him to it. Dangote's Sh2 trillion refinery bet. From a contested idea to excavators on the ground: one quarter. Uganda's flagship PPP: twelve years and counting on a road one-tenth the size. And here is the part that should sting. The President of Uganda was at the Lamu groundbreaking. By Ruto's own account, it was he and President Museveni who first thought an East African refinery wise. The idea was shared. The execution was not. Uganda's head of state flew to Kenya to watch a neighbour build what Uganda's own laws would have strangled in a committee. Why Kenya moved and Uganda cannot The refinery is not a textbook PPP, and that is precisely the lesson. Kenya did not run it through a procurement machine. It treated a serious investor as an investor: secured the land, agreed the terms at the top, and let the private party carry the risk. Dangote offered regional governments a combined 30% stake; he pledged to list the refinery on the Nairobi Securities Exchange; he is developing it with the Africa Finance Corporation. The State's role was to say yes clearly and quickly, and to defend that yes. Uganda's law makes that impossible by design. A law written to police investors, not to attract them Read the PPP Act and ask one question: who is it protecting? Every clause protects the State from the private party. Almost none protects the private party from the State. The Act creates a PPP Committee, a PPP Unit, a contracting authority, an accounting officer, a project officer, a project team, a process auditor, a transaction adviser and an evaluation committee. That is nine gatekeepers before a single shilling of private money is committed. Each one can say no. None of them can say yes on their own. The regulations to operationalise the Act took years to arrive. A framework that took a decade to finish its own paperwork cannot lecture investors about diligence. Picture Dangote walking into that process. Feasibility study to the Unit. Approval of the study by the Committee. Transaction adviser procured under PPDA rules, with its own appeals window. Process auditor appointed. Evaluation committee convened. Each step a quarter, each quarter a budget cycle, each cycle a new accounting officer who was not in the room when the last one said yes. He would still be waiting for the Committee's minutes while the Lamu plant was taking its first crude. Procurement logic applied to the wrong transaction The result is a process designed for public procurement, not for private investment. Public procurement exists because the money is public and must be defended. A PPP is the opposite case. The money is private. The risk is private. The investor is already the most motivated auditor of the deal, because if the numbers are wrong he loses his own capital, not the taxpayer's. Treating him like a contractor bidding for a government cheque misreads the transaction entirely. Kenya understood this. The Lamu project has real problems ahead of it, and I will not pretend otherwise. A court has let a group claiming the land maintain the status quo until an October hearing, and the plant needs regional crude above 700,000 barrels a day that does not yet exist. But those are the risks of a project that is actually happening. Uganda's risks are the risks of a project that never starts. Only one of those can be fixed on the ground. What Uganda would have to change Three things, and none of them is another regulation. First, replace the nine-gatekeeper chain with one accountable decision-maker per project, empowered to say yes and answerable for it. A deal that nobody can approve is a deal that nobody will bring. Second, split unsolicited proposals from public procurement. An investor who brings his own money, his own feasibility and his own risk should negotiate, not tender. Competitive bidding has its place; it is not the place where a sovereign is being offered USD 16 billion. Third, put the President's signature where the investor can see it. Kenya's deal moved because the head of state owned it in public and attended the groundbreaking. Uganda's head of state attended too, as a guest. Twelve years. Zero deals. The law did exactly what it was written to do: protect the State from investment. It has succeeded completely. Joel Aita @KagutaMuseveni
