🚨 A Defining Examination of the Rule of Law and Judicial Independence in Tanzania Although I am not a citizen of Tanzania, the protracted prosecution of Mr. @TunduALissu, chairman of the principal opposition party Chadema and a longstanding advocate for constitutional and electoral reform, commands sustained international attention. For more than sixteen months Lissu has remained in pretrial detention on a single count of treason under section 39(2)(d) of the Penal Code, an offence that carries the possibility of capital punishment and for which bail is unavailable. The charge arises from remarks he delivered on 3 April 2025 concerning the necessity of electoral reforms prior to the conduct of the 2025 general election. The prosecution has closed its case after presenting seventeen witnesses; the defence has completed its evidence; and the matter now rests with a three-judge panel of the High Court Justices Dunstan Ndunguru, James Karayemaha and Ferdinand Kiwonde for final submissions and judgment. What is at stake extends far beyond the liberty of one political figure. The proceedings test whether a political disagreement over the conditions of democratic participation may lawfully be converted into a capital criminal prosecution. Human Rights Watch (@hrw) has characterised the charges as fabricated; Amnesty International (@amnesty) has called for Lissu’s immediate and unconditional release. Both organisations have documented a broader pattern of constraints on opposition activity and civic space. The defence has contested the prosecution’s construction of Lissu’s words, argued that the evidence fails to establish the specific intent required by the statute, and noted the absence of testimony from senior officials who might have spoken directly to whether those words were perceived as a genuine threat to the government. Lissu himself has observed that the eventual judgment will establish a precedent of lasting significance. That assessment is accurate: the outcome will signal whether Tanzania’s constitutional order prioritises the protection of individual rights and the integrity of judicial process over the instrumental use of the criminal law against political dissent. I therefore address the three justices with the utmost respect for their constitutional office. Their duty is to examine the evidence presented, apply the governing legal standards without regard to extraneous considerations of political expediency or pressure, and determine whether the prosecution has discharged its burden of proof beyond reasonable doubt. As Lissu has himself submitted: if the evidence does not fit, the accused must be acquitted. The panel holds not merely the fate of one individual but the credibility of the judicial institution itself. I address the Government of the United Republic of Tanzania with equal directness. Political dissent, however robustly expressed, must not be treated as a criminal offence. The deployment of a capital charge of treason as an instrument for narrowing the space for opposition, deterring civic participation, or resolving electoral disputes is incompatible with the principles of constitutional democracy and the international human-rights obligations Tanzania has assumed. The demand is not that any person stand above the law; it is that the law stand above transient political power. Where the evidence fails to meet the statutory threshold, continued detention serves neither justice nor the long-term interests of the Tanzanian state. The international community is observing these proceedings with close attention. History will record whether the judiciary discharges its responsibility with independence and fidelity to the evidence, or whether the coercive capacity of the state prevails over the protections the Constitution and the rule of law afford the individual. Justice cannot be subordinated to power. Judges must not be deterred from acquitting when the evidence requires it.

RENEGADE SUNDAY THOUGHTS: So one of my friends catches me out of the blue with a subversive offer during our chat over coffee: “Sleeping on your left side is generally considered better for the whole health of most people. “There is a widely observed cultural and psychological phenomenon in which the men tend to sleep on whichever side of the bed is closest to the bedroom door to the right; which too often is the right side. Historically, placed between the entrance and their partner, the one sleeping closest to the door acts as a ‘buffer’ or first line of defence against an intruder, wild animal, or any other hazard. “One might argue that in so-called “long battle of the sexes’, the men lost it when they fell in for the delusional chivalry that they were the only brave ones who could face the wild animal”. I guess since the invention of the modern bed, the ladies have just been chalking up the points. Will miss these guys when I eventually retire to live in solitude in the forest.

Sunday is when we settle it — the borrowed money, the family group chat insults, the neighbor's goat that ate your tomatoes with no remorse. "A quarrel between brothers benefits the thief." Look, Africa has too many thieves. Stop fighting over crumbs while the chef escapes with the kitchen and the bar. Focus ! 6. GRATITUDE — FIRST FRUITS. We thank before we eat. Meanwhile some only remember God when the traffic police appear or when a spouse finds those WhatsApp messages. But gratitude is no excuse for mediocrity and toxic inaction. Thank God AND register to vote. Pray AND organize. No one gets a Nobel Prize for accurately describing the stench of the status quo. 7. TRANSMISSION — THE ELDERS SPEAK. Sunday afternoons: proverbs fly, secrets surface, and suddenly your entire personality is explained. "Wisdom is like a baobab tree; no one person can embrace it." 🚨 TANZANIA MUST PRODUCE PROOF OF LIFE FOR FORMER VP EMMANUEL JOHN NCHIMBI The most urgent question facing Tanzania today is not whether Emmanuel John Nchimbi formally resigned the vice presidency. It is whether the Tanzanian authorities can demonstrate, in a manner that meets basic human-rights and evidentiary standards, that he remains free, unharmed, and able to communicate without coercion. On 25 August 2026, a resignation statement appeared on Nchimbi’s Instagram account an account that had been inactive since March 2023. The statement announced his retirement from politics and public service, effective 4 September 2026, and stated that he had become convinced President @SuluhuSamia desired a different vice president and that he was therefore honouring a prior undertaking to step aside. The provenance of that communication has never been independently verified to a standard appropriate for a sitting senior state official. Local reporting indicated that Nchimbi later told journalists he had left politics, yet the public has received no sustained, independently verifiable account from him explaining the circumstances of his departure, his present location, or the sequence of events that took him from the second-highest constitutional office to complete silence. Nchimbi was not a peripheral figure. He was President Hassan’s running mate, Vice President of the United Republic of Tanzania, and a former CCM secretary-general. His removal proceeded with extraordinary speed. After the Instagram announcement, CCM expelled him on 26 August 2026 on disciplinary and ethical grounds and endorsed Energy Minister Deogratius Ndejembi as its nominee. The Attorney General subsequently stated that Nchimbi ceased to hold the office of Vice President on 26 August because loss of CCM membership removed a constitutional qualification, notwithstanding the 4 September date contained in the resignation notice. Legal mechanisms may explain the formal vacancy of the office. They do not answer the human-rights question: whether Nchimbi remains free, secure, and able to speak publicly without fear or constraint. This concern is heightened by his recent public advocacy for constitutional reform and by contemporaneous reporting that he had come under political pressure to relinquish office. The suspension of the newspaper MwanaHALISI shortly before his resignation, after it published claims that he was resisting such pressure, renders the chronology still more serious even while those specific allegations remain unproven. Nchimbi has not been seen in public since approximately 20 August 2026. He has not answered calls from friends, family, or former Prime Minister Joseph Warioba since 26 August. He was absent from the swearing-in of his successor. Unverified reports circulating in Tanzanian media and on social platforms claim that his devices were confiscated and that he is being held incommunicado. No Tanzanian official has confirmed that he is in custody. Equally, none has confirmed that he is free. This silence does not occur in isolation. It arises against a documented pattern of unresolved disappearances and political violence. In October 2025, former CCM official and ambassador Humphrey Polepole was taken from his Dar es Salaam residence. His family reported a broken door, blood at the scene, and other signs of a violent struggle. @amnesty and @hrw called on the authorities to establish his whereabouts and the circumstances of his disappearance. His fate remains unknown. International human-rights law treats enforced disappearance not merely as the physical removal of a person, but as a continuing violation compounded by the denial of information concerning that person’s fate or whereabouts. The right to life, liberty and security of person, and the prohibition of enforced disappearance, bind Tanzania under both the International Covenant on Civil and Political Rights and the African Charter on Human and Peoples’ Rights.

We therefore demand the following: 1. The Government of the United Republic of Tanzania must immediately produce independent, verifiable proof of life for Emmanuel John Nchimbi. This must include a public, unscripted appearance or communication in which he is free to confirm his location, safety, and voluntary capacity to speak, without the presence of security personnel or political handlers. 2. The authorities must disclose, without delay, his precise current location and legal status, and guarantee his unrestricted access to independent legal counsel, medical examination if requested, and family contact. 3. An independent, transparent investigation must be opened into the circumstances surrounding his resignation, the subsequent silence, and any allegations of coercion, detention, or restriction of movement. 4. The international community including the African Commission on Human and Peoples’ Rights, the @UN Special Rapporteurs on extrajudicial executions, enforced disappearances and freedom of expression, the @_AfricanUnion , and relevant diplomatic partners must urgently intervene. They must press for immediate proof of life, demand unimpeded access to Nchimbi by independent monitors, and insist that Tanzania end the pattern of enforced disappearances, political intimidation, and media repression that has characterised recent years.
