Cal mom for safety @CalMomForSafety

"Ertmoed was denied day parole last year because he still posed a risk of serious harm to others." I oppose the death penalty but we need to bring back retribution as the guiding principle for the most serious crimes. With exceedingly narrow exceptions, if you intentionally kill someone, you spend every day of the rest of your life in prison, period. (Also, guys like this can't be "cured.")

In 24 years of watching 9/11 memorials and the reading of the names of the dead, I have never heard applause. This morning the crowd did — because one brave widow, @TerrySStrada, looked at the leaders in front of her and refused to let the day pass in silence. She called out Saudi Arabia’s role, the broken promises, and a string of administrations that protected the Kingdom instead of helping to deliver justice for the families. A stunning, must-watch minute. Stand with the families.

@CricketKiddy @annbauerwriter Thank you. Apart from any other issues, he is NOT a good dancer.

Exactly. There is nothing wrong with men WANTING to perform feminine roles but it's a niche culture. It's OK to maintain "traditional" M/F roles for mainstream cultural institutions, whether it's NFL dance teams or the Rockettes. Some professional sports teams DO have coed dance squads, but the men don't dance like this.

@sfmcguire79 @FriedrichHayek The camp is 2.5 miles from main campus but practically adjacent to UC Berkeley's family housing complex, which is problematic obviously. A fed judge is tying the city's hands with an aggressively stupid legal theory. UCB is in fact fantastic and students should still attend.

Yes, a federal judge's use of an absurd legal theory to block the city from clearing this humanitarian disaster should be a national story. Also, the cope in some of the replies are wild: this is, in fact, very close to UC Berkeley FAMILY housing and not that far from main campus. It's also near a business district that includes Whole Foods. WF, and part of the housing, were within the high risk zone during the recent lepto outbreak at the camp.

@JamesLucasIT The mom wanted to come but stayed home to look after the younger siblings. She prepared the sandwiches wrapped in wax paper the boy holds on his lap.

@EithanDHaimMD Also, is "a small number" of wrongly coded patients relative to gender patients only, or to all Cleveland Clinic patients? CC is large. Even if all or most gender patients were wrongly coded, CC could still claim it was a minor issue relative to their entire patient population.

@BrandiKruse @ADFLegal Gutless prosecutor. "Difficult to prove" ≠ "cannot prove." Rape is provable beyond a reasonable doubt based on victim's testimony alone; corroborating "witness statements" are not required. The DA's sports consent analysis is also highly suspect.

@babbington12 @DavidAFrench @ClaireBerlinski Well said!

@FischerKing64 My daughter, a Berkeley rising senior, has seen standards deteriorate significantly in her humanities major over the past 3 years. (BTW her math SAT was 760, for all the people who think humanities=dumb.)

@herandrews @michaelbd Or robbery. Retail theft is the easy, low risk way to make money. Robbery crews steal a car and drive around robbing pedestrians because it's fun to hunt "prey."

@AAGShumate The hospital has "neither filed a motion to quash nor shown just cause for noncompliance." Doing nothing, even if you really, really, REALLY dislike Trump, is not a viable response to a subpoena.

@BrandonWarmke Yep, it's not the "missing mother" topic itself that's the problem, it's the structuring of an ENTIRE COURSE around it. How boring to spend an entire semester reading books through that one lens.

@StephenESachs Fantastic thread, thank you.

@KevinKileyCA Are the officials who made the improper statements still on the Commission?

You don't have to be religious to appreciate ADF's incredible record of success. Their plaintiffs may be motivated by faith, but the resulting decisions protect everyone's freedom of speech & association. As an agnostic, I think it's fair to say that Americans of faith, particularly Christians, have in recent years done more than their fair share to protect our liberties.

In addition to the viewpoint discrimination, it's appalling when universities threaten or bring student conduct proceedings to stifle protected speech they disfavor. Just from having 2 college kids, I've seen it in different contexts - including a university employee who threatened freshmen with discipline if they called police on a dorm intruder!

Look, I find the student government statement appalling. But the UCLA response is inappropriate, at least in part. "We will review the process by which this letter was issued." What does that mean? The student government letter, however misguided, is protected speech. No student group or university unit is required to adhere to an approved message or structure their free speech events in a particular way. That goes for Hillel and the Nazarine Center. It also goes for the USAC. I wish UCLA had made that point in their response.

For those who remember the City of Grants Pass case, where the Supreme Court held that (obviously) cities can enforce generally applicable anti-camping bans on the public roads and sidewalks without violating the Eighth Amendment, it may not surprise you to learn that the Grants Pass decision is effectively a dead letter in many jurisdictions. Plaintiffs and federal judges have found many other theories to stop cities from cleaning up the streets and sidewalks. Consider this case from Berkeley -- not exactly a bastion of conservatism! Berkeley wants to remove a large homeless encampment because, among other reasons, there was an outbreak of Leptospirosis. Well, a federal judge in San Francisco has ruled that removal of tents and RVs are subject to...the Americans with Disabilities Act! Think about how crazy that is. The ADA requires reasonable accommodations for disabled persons so that they can enjoy City programs and services. But what the judge has effectively ruled is that ADA claimants are entitled to reasonable accommodations from generally applicable laws. That's like says there is an ADA exemption for murder or theft. Obviously that's preposterous. Generally applicable laws are not programs from which one can exempt one's self by claiming to be disabled. The judge also ruled that by removing tents, the City is creating a danger under the state-created danger doctrine and thereby violates due process. I don't know of any case where enforcing generally applicable laws has been held to create a danger. Again, these doctrines aren't intended to allow exemptions from general legal prohibitions. How long do cities and their residents have to live like this? How long until we recognize that allowing several individual federal judges to play God-King-Legislator is unsustainable? By the time this gets up to the Supreme Court, it will have been over a decade since the original Boise decision that disabled cities from enforcing camping bans under the Eighth Amendment. Over a decade where cities and their residents couldn't adopt reasonable policies. THIS is why the SHADOW DOCKET exists. Because federal judges keep doing crazy things, and it's only a matter of time before they get overturned. In the meantime the public health and safety, and our democracy, suffers for years and years.
