@noremachi This has no impact on donations and bits. It only has impact on personal paid subs, not even gift subs. I agree: This should be non-refundable live content, but even if they don't consider it that: It's not as severe as people think.

While I agree it should, there is a legal obstacle here. The phrasing states the "content" must start "after" you waived your rights. In the case of Twitch, the content is delivered before you waive that right. This will be something that needs more commentary from the European Commission.

@ToriProductionz I think you may have misunderstood. This is for PERSONAL subs only. Gift subs are not part of this regulation. If they want to force a chargeback fraudulently they would still need to do that through the old fashion way.

@MrAtomicDuck There's a problem here though: The "performance" started and you had access before the subscription took place. I wonder if there is a caveat here for the "Subscription" permission or if that requires "added value" that is separate from what Twitch offers.

@CrReaM The problem is not that Twitch implemented it. They have to! It's how they did it: Subscriptions fall into the "performances starting immediately" category. There is a carve out that introduces an opt-out waiver.

@PandaTVoce The problem is not that Twitch has to comply. I am VERY much pro Consumer-protection in the EU. The problem is that this is "live delivery", something for which the law has a carve out to prevent abuse.

@thegreengiant88 Completely agree. But this doesn't fix that unless they stop within the first two weeks. "Sub in advance" should have a caveat that automatically stops the sub if the creator hasn't been live in 30 days.

Twitch opted for the wrong solution. The right to withdraw does not apply to "Digital Products" for which "the performance starts immediately". All the need to do is a one-time waiver before the first subscription and they could have avoided the whole "Withdraw from Sub" fiasco.

It doesn't have to be like this though. There is a carve out for "performances starting immediately" saying a one time agreement by the user waives the right to withdraw. Either before every sub or only your fist-ever and the whole trolling/gacha game against streamers can be stopped.
