The adder has been heavily litigated. In January 2025 a federal appeals court directed FERC to strip it from Ohio utilities, where membership is mandatory. California, Connecticut, and Ohio already require RTO participation, which makes those utilities ineligible for the incentive.

Third, mandating RTO participation. Because Indiana’s is currently treated as voluntary, utilities collect a 0.50% FERC ROE adder on transmission. A mandate would remove it and put downward pressure on retail rates.
The IURC just released its July 2026 Energy Affordability Report, built on 10 statewide listening sessions and roughly 2,170 public comments. It lays out 16 action items across the Commission, utilities, OED, and the General Assembly. A few worth watching. 🧵

The settlement includes a withdrawal provision. Settling parties have 15 business days to determine whether the Commission's modifications are unacceptable. If any party pulls out, the proceeding returns to litigation.
BREAKING: The IURC has issued its Final Order in @AESIndiana electric base rate case, authorizing a $71M revenue increase, a 63% reduction from what the company originally requested. The Commission approved the October 2025 settlement, but not without modifications.
