At trial the State must meet stricter foundation, confrontation, and reliability standards. Candace is correct to flag that the hearing is a low-bar filter, not a preview of what a jury will ultimately hear under full adversarial testing. 2. “Robinson is also charged with murder, not just aggravated murder.” The charging documents lead with aggravated murder under Utah Code § 76-5-202 (a capital felony), specifically alleging the defendant “knowingly created a great risk of death to another individual other than Charlie Kirk and the defendant,” plus victim-targeting enhancements. That is the charge that opens the death-penalty door. There is no separate simple-murder count that changes the analysis. Distinguishing aggravated (capital) murder from ordinary murder is not ignorance it is the central legal distinction that determines the stakes. Candace’s focus on the capital nature of the primary charge is accurate. 3–5. DNA vs. fingerprints, “degraded” DNA, and dirt inside the rifle. These are classic trial issues of interpretation and reliability, not “gotchas” that prove Candace does not understand forensics. At the preliminary hearing, lab reports come in as reliable hearsay under Rule 1102(b)(4) with minimal foundation. At trial, defense counsel will cross-examine the analysts on degradation (which can speak to secondary transfer, contamination, age of the deposit, or recovery conditions), the difference between touch DNA and fingerprints, chain of custody, and environmental factors such as dirt inside the rifle (handling, storage, recovery timing). Treating those points as irrelevant or already settled at the prelim stage is the real misunderstanding of Utah procedure. Candace is pointing out interpretive weaknesses that the low probable-cause threshold does not resolve. 6–8. Confession to being the person on the surveillance footage, Twiggs’ identification, and use immunity. Lance Twiggs’ statements are classic out-of-court statements offered for their truth hearsay. They were admitted under the expanded “reliable hearsay” umbrella of Rule 1102 (recorded statements under oath/affirmation or penalty notice). Use immunity removes the risk that Twiggs’ own words will be used to prosecute him, but it does not magically make the statements more truthful or eliminate motives (self-protection, relationship dynamics, deal-seeking, or pressure). Utah deliberately allows such material at the prelim without full live confrontation precisely because the hearing is not the trial. Questioning the strength of an immunized roommate/partner’s identification and alleged confession is not ignorance of the rules; it is recognition that those statements will face far more rigorous testing later. Candace is right to treat them as provisional rather than conclusive. 9. “Defense lawyers had every incentive to advance her theories at the preliminary hearing but chose not to.” This misunderstands defense strategy under Utah R. Crim. P. 7B. The burden is entirely on the State. The defense may cross-examine and present evidence, but it is under no obligation to preview its full case, put on alternative theories, or litigate every factual dispute at the probable-cause stage. Doing so can waive rights, lock in testimony, or give the prosecution a free look at the defense. Choosing a limited approach does not equal an admission that Candace’s points lack evidentiary support. It is standard, cautious lawyering at a low-threshold hearing. 10. “The difference between speculation and reliable hearsay under Utah rules.” Rule 1102 defines categories of evidence the legislature and courts have deemed reliable enough for probable cause. It does not convert every inference drawn from that evidence into ironclad fact. Candace’s position is that the State is stacking hearsay (video ID + roommate statements + forensic reports) and then asking the magistrate to treat the resulting narrative as solid. Utah law allows the magistrate to make limited credibility assessments, but the full reliability fight—including alternative explanations for DNA placement, video identification quality, timing of deposits, and the weight of immunized statements belongs at trial. Calling that distinction “speculation” misstates how Utah separates the prelim filter from the ultimate proof beyond a reasonable doubt. Bottom line on Utah law: The preliminary hearing is intentionally one-sided and hearsay-friendly so the State can obtain a bind-over without a full dress rehearsal. Candace’s repeated insistence that the hearing does not equal a trial-ready case, that much of the narrative rests on material that will face stricter rules later, and that forensic and identification issues remain open for challenge is consistent with Rule 1102, Rule 7B, and the limited purpose of the proceeding. Barnes, your list treats the preliminary hearing as if it already resolved the case under trial standards. That is the actual error.
