@flaman78 @SarahisCensored And chain of custody goes to basic admissibility no matter what is found. Let’s say they find something on the phone incriminating…. It likely cant even come it unless chain of custody cleared and content authenticated. It’s just nad for in my view.

The chronology is this: -Smith's team won a series of rulings in late 2022/early 2023 permitting access to records/testimony of Trump White House officials, overriding executive privilege and, in some cases, attoreny-client privilege. -In June 2023, Smith's team subpoenaed for Trump White House records from the National Archives. Some of those records happened to include contacts between the Trump White House and members of Congress. -Smith's team team immediately shared those records with Trump's legal team in discovery, per the records Grassley released. -Speech/debate protection is very broad, and its outer edges are frequently litigated, but its primary purpose is to prevent the Executive Branch from intimidating/coercing the legislative branch with prosecutorial authority. Whether returns from a subpoena to the National Archives for messages sent from White House phones would be screened for speech/debate privilege is not a foregone conclusion. -Side note: Smith inherited and pursued a two-year speech/debate case to access messages sent and received by Rep. Scott Perry, ultimately winning a narrowed ruling that explicitly extended speech/debate protections to cell phones for the first time.
