Pay close attention to change-of-law provisions in #NIL and revenue-sharing agreements. If the Protect College Sports Act (or similar legislation) passes, it could significantly impact existing and pending deals. Avoid granting the payor sole discretion to terminate upon a change of law. Another eligibility win against the NCAA- a Chambliss style contract claim, and another example of why the NCAA likely scraps its medical waiver system soon. Athletes are winning by arguing that the NCAA is misapplying its medical waiver rule. Too much subjectivity leaves the NCAA open to attack. No medical waiver system means no more lawsuits claiming the medical waiver system was applied unfairly.

The NCAA has recently been canceling pending eligibility extension and season-of-competition waiver requests outright rather than deciding them on the merits. I'm seeing this increasingly in active matters right now. It appears the administrative process is being dismantled ahead of the new five-year rule. Where the facts justify it, court remains the only reliable path, particularly given the NCAA's newest strategy of essentially not even reviewing what was submitted.

Instead of replying to all the comments or questions, I figure it might be easier to just respond here. I know some people have in mind certain types of growth for what they’re familiar with in their communities. The beauty of Florida, all 67 counties and 412 cities, towns, and villages have the ability to solve challenges locally through the Florida Home Rule Statutes. Yes, when big developments come in they usually install the infrastructure to the utility specs and then turn it over to the utility and/or they pay impact fees based on the utilities needed and the utility company installs it. This is through the enterprise fund. However, there are projects of public benefit that are funded by matching dollars from general funds and/or specifically allocated property tax assessments for debt service that are bonded out. Usually referred to as general obligation municipal bonds in the financial world. There’s also Community Redevelopment areas that are cost shared with the municipality and the county. There are funded with property tax and used on a specific focus area to improve with similar ties of projects. The logic behind this is you end up maintaining the current property owners property tax and at the same time increasing the taxable value of the newly developed properties. Many of these properties were previously single family homes, run down properties, or undeveloped land. The increased tax revenue from these properties can actually spread the tax burden to more people and will sometimes reduce the individual taxes. Every situation is different and that’s why it’s important to be involved in the local decision making process. I acknowledge that there are always some bad actors, but we should hold them accountable with real numbers. Specific examples of waste, fraud, and abuse by what funds were used and who approved. That is why we have audits every year and line item audits on bigger ticket projects. Hope this provides more clarity. #FlaPol

@GovGoneWild, When do impact fees occur? After development is already here. How do you bring economic development into your community? By investing in infrastructure projects to attract employers. (Chicken and egg) You can’t wait on impact fees to support projects that have to be completed before they come. Impact fees don’t pay for everything, there are costs indirectly affected by growth. It is a small part of it. There are cost share projects with grants and other partners that you have to use GF dollars as the matching portion.

Wrong. Infrastructure is paid for by the growth itself in the form of impact or user fees, not your property taxes. If your local government is paying for growth via property taxes then they’re giving builders and developers a free pass.
