Of course they are doing it on purpose and it's for at least two reasons: They have taken the most extreme however the safest route when it comes to protecting proprietary information linked to their trade secrets. And they do not see retail investors as more than a line item, it is corporate and institutional investors that will make the future possible for the company. Doesn't change its a horrible communication strategy.

It's not good or bad news, rather what I am showing is that investors will invent or distort information. Like what this guy posted, it is clear that he is frustrated and is venting but Ryan never said in the coming weeks. And due to the development cycle style of PRs that ABAT has adopted it is a common occurrence. Honestly, social media is more prone to invent positives than negatives but this one rubbed me wrong so I decided to call it out. But this is why social media should never be used as the basis for any kind of trade or investment strategy.

On October 16, 2025, $ABAT released the Preliminary Feasibility Study (PFS). Even accounting for Ryan's known troubles when it comes to how the concept of linear time works, it is highly doubtful he would have said a DFS in the coming weeks the same month they published the PFS One of the things I have said for some time is unless a milestone has a C-suite award attached to it, the chances of ABAT achieving it are rather low. But this is also why they switched from giving specific dates or times and use very generic terms like "shortly" and slap a forward-looking statement disclaimer on everything. The company can shoot itself in the foot just fine, and really doesn't need retail making things up as well.

Been a while since we got an update from BHE Renewables on lithium extraction from geothermal brines at the Salton Sea. They teamed up with a subsidiary of Occidental Petroleum, Terralithium, in 2024 for direct lithium extraction (DLE) and the lithium precursor conversion. They have been able to produce lithium chloride from the geothermal brine and convert that into lithium carbonate. They have also proven out their electrochemical process to convert the lithium chloride directly into lithium hydroxide. The Berkshire Hathaway energy company has had its ups and downs over the years from receiving then having to return grants to swapping technology partners for the DLE. But they have now said they have reached the testing milestones where they can now start using that data to base their designs and scale up to a demonstration scale of the platform with the eventual goal of building and operating commercial scale lithium extraction platforms that are tied to their geothermal plants in California.

Going to share one of the slides from a 2021 investor deck, that showed revenue for Q2 2022. Of course as we all know it was close to 3 years after that when they first recorded revenue. Is Ryan a fraud for that? This is how startups work, especially ones that are pretty much inventing it as they go along. And should have been something you were fully knowledgeable about long before you bought your first share.

Major construction at @ThackerPass continues as we target mechanical completion in late-2027. This month, we achieved a safety milestone of three million work hours on-site and five million total project hours without a lost time incident. Currently, there are approximately 1,600 workers on-site at Thacker Pass. Interesting tidbit in the purchase agreement between Ascend Elements and R3 Lithium is that if the Blugrass, another company created for the bankruptcy, but this one was by Kinterra, but if they do not exercise their option to purchase the Poland assets, then Ascend Elements will notify R3 Lithium, who then can exercise their option and purchase it. It really does look like, since R3 Lithium is only a couple of months old, and one of the two employees of Axial Partners, who was a direct investor in Ascend, is listed as the director of the R3, it looks like after they encountered all of the objections from the creditors and saw that there was no way to retain the Kentucky site via the bankruptcy proceedings, they created the R3 Lithium entity to possibly keep as much as they could under one roof, and to require what they could after the bankruptcy closes. The main thing is the actual sale hearing has not been held, so the sale of the Georgia asset is not 100% locked in yet. There is nothing in the purchase agreement about Kentucky but I am sure the lawyers for the creditors will have some things to say about everything else.

The final main asset has been sold in the Ascend Elements bankruptcy, the Covington, Georgia location. R3 Lithium, which looks to be a new subsidiary of the clean tech venture firm Axial Partners, is being designated as the winning bid, after no other competing bid was recorded.  They are paying $3.0 million in cash. Plus, they are going to assume all liabilities for the location as well as pay any of the costs that are needed for the site. This would include past bills and the damages the landlord has claimed.  I do not know the exact connection, beyond Axial Partners and Ascend Elements having had a professional relationship even before the bankruptcy. The purchase agreement is around 140 pages, so I will dive into it after Abe and I go for a morning walk.

There are potential positives and negatives in Kentucky for $ABAT. The site is now owned by TKJV, and is clear of any liens but not obligations. There is, of course, the DOE equipment, an ongoing dispute over more of the equipment by WPI because the configuration it is in now would violate their patents if it was used. There are also financial obligations that are tied to the local and state governments. All of this I am sure TKJV is going to try to offload. As for RMF Nooter, while like I said the site is now free of liens, I am sure there are still plenty of legal maneuvers they still plan to use to try and get more out of this barrel of money. The site itself seems to be chock-full of problems. The movie The Money Pit with Tom Hanks comes to mind, and would explain why instead of raising their bid, ABAT was trying to use the pathway route to secure the winning bid. The only way I see this working is if TKJV takes on the burden of rectifying a lot of the problems construction-wise before a private sale. The best route, however, may be ABAT working with the DOE to gain ownership of the equipment and using it at another location.

Ascend Elements just settled a civil fraud claim with the DOE over inflated billing on its Kentucky Lithium-ion recycling facility.

Agreed with literally all of this. Also a reason in the long run, IMO, to invest in mining equities rather than the commodities themselves. In 1873 Rio Tinto bought the Huelva mine in Spain for £3.68M (£355M in today’s money according to the BOE). At that time the copper price was 28 cents a pound, or about $7 in today’s terms. Fast forward 150 years and the copper price in real terms is almost unchanged (in fact, it was much lower until very recently) but that original mine, despite more than a century of operations, is now worth £1.3B as Atalaya Mining (a position of mine). In the short run, miners can underperform physical. But in the long run, miners get better, and that’s why the price of physical commodities, generally speaking, goes lower and lower with time.

@HankRuehl 100%. It also needs to be easily replicable between deposits, without repeating a lot of the R&D work - as far as I remember this used to be(?) one of the major obstacles to unlocking more leachable resources. I think I fundamentally agree with folks such as @DoombergT who say

It's not a neutral sentiment, I am an investor that means I look at all aspects of the company. Are there positive things yes and I talk about them, are there negative things about them yes and I talk about them. But my sentiment doesn't change based upon what I am covering at that moment, if I didn't think a company was worth it I wouldn't own them. It really is that simple and that is why I say I am not bullish nor am I bearish I am just an investor. As for how much I am still keeping up with them? I guess you don't read the Critical Materials Bulletin. Of course, I am not bullish on $ABAT, nor am I bearish. I am an investor, but if I did not think that the company was not worth my time, why the heck would I still be around reading redacted reports and sorting through pages and pages of FOIA requests for everyone. When I do write ups about ABAT, unlike other topics I will cover It is always free, well for the first 2 months, then it gets put behind a paywall by Substack. I made a promise that I would always release my work free to the community. Years ago, I was invited to ABAT’s new office. When we got there, Abe went running into the main office after hearing Scott’s voice when he yelled: “Did you bring my dog?” While Abe was getting attention from Scott, I had conversations with a few people, and I told them I am very passionate about what they are trying to achieve. This was back when Fernely was just a thicc slab. But I also said I am an investor, so I am also here to make money. I have no clue who this guy is, but interested how he has the inside scoop about my feelings for ABAT, however I have said before that my ABAT bag is rather small now. That is because I am semi-retired, and my main funding comes from savings and a few bucks I get from the Critical Materials Bulletin. But my opinion on the company has not changed since that conversation at ABAT’s office, and that is why I still do my ABAT write-ups for free and try to help the community of retail investors when I can.
