Lesebefehl! Regen in Ecuador Die Klägerin hatte für sich und ihren Partner eine einwöchige Pauschal-Rundreise nach Ecuador Ende Dezember 2021 für einen Gesamtpreis von rund 18.000 € gebucht. Nach Durchführung der Reise verlangte sie eine Minderung von rund 6.000 € des Reisepreises. Sie begründete dies insbesondere damit, bei einer Rundwanderung um einen laut Reiseankündigung „traumhaft schönen Kratersee“ sei von dem See wegen Nebels nichts zu sehen gewesen. Starkregen und Nebel hätten außerdem bei einer Fahrt durch die Westkordilleren die Aussicht auf die Landschaft verhindert. Auch während einer zweitätigen Durchquerung des Amazonas Dschungels hätte wegen des starken Regens von der versprochenen Tierwelt nichts erblickt werden können. Der auf dem Programm stehende Besuch einer Fledermaushöhle habe wegen Überflutung nicht stattfinden können. Darüber hinaus habe es in einem Hotel kein warmes Wasser geben. Bei einer späteren mehrtätigen Fahrt auf einem Katamaran sei der Lärm durch einen defekten Generator so erheblich gewesen, dass sich die Reisenden in der zweiten Nacht entschlossen, an Deck zu schlafen. Der Katamaran habe dann nicht in Santa Cruz, sondern in Baltra geankert und zwar mit Blick auf die örtliche Tankstelle und den Flughafen. Schließlich sei ein Tagesausflug ausgefallen. Die Reiserechtskammer des LG Frankfurt am Main gab der Klage teilweise statt. Entgegen der Ansicht der Klägerin habe der Reiseveranstalter zwar nicht darauf hinweisen müssen, dass im Dezember in Ecuador Regenzeit herrscht. Denn dies hätte bereits durch eine einfache Internetrecherche erkannt werden können. Wetterbedingungen seien nicht Leistungsbestandteil der gebuchten Reise. Demgegenüber erkannte das Gericht aber eine Minderung von 10 % des errechneten Tagesreisepreises für den unterbliebenen Besuch der Fledermaushöhle, in Höhe von 20 % des Tagesreisepreises für die fehlende Warmwasserversorgung in einem Hotel, von 30 % für die Lärmbelästigung auf dem Katamaran und 40 % für den entfallenen Tagesausflug sowie die Anfahrt von Baltra statt Santa Cruz mit Blick auf Tankstelle und Flughafen. Diese Reduzierungen der Tagesreisepreise führten zu einer Verurteilung des Reiseveranstalters auf Zahlung von rund 800 € an die Klägerin. Das Urteil vom 15.3.2023 (Aktenzeichen 2-24 O 102/22) ist nicht rechtskräftig.
