THE RULE OF LAW - OR THE RULES OF THE GAME? I have now published a forensic analysis of Dominic Cummings’ evidence concerning the Vaccine Taskforce. Read carefully, the material raises a constitutional question far greater than procurement bureaucracy, administrative speed or personalities. It concerns the attitude of the Executive towards the rule of law itself. Cummings told Parliament in May 2021 that the approach communicated to Kate Bingham was: “Treat this like a wartime thing. Ignore rules.” And if lawyers got in the way, return to the centre and ways would be found of “bulldozing them out of your way.” His subsequent evidence to the Covid Inquiry makes it considerably more difficult to dismiss those words as colourful rhetoric. The operating philosophy he describes was real: Ordinary Whitehall processes could be circumvented; procurement constraints could be put aside; obstructive legal advice could be escalated and overridden; and the Vaccine Taskforce was deliberately constructed with exceptional authority flowing directly from the centre. And Patrick Vallance was not standing somewhere on the scientific sidelines. According to Cummings, Vallance was there at the architecture stage. Cummings records that Vallance proposed establishing a Taskforce on 24 March 2020; that they agreed it should sit outside DHSC; and that Vallance thereafter remained centrally involved in its development and operation. The paper concludes that any proper forensic reconstruction must therefore treat Vallance as a central witness, not merely as the scientific adviser adjacent to the project. But perhaps the most constitutionally extraordinary feature is what Cummings says about the Prime Minister (then, Boris Johnson @BorisJohnson) and judicial review. The Taskforce was to be free of normal bureaucracy, including procurement rules and the Prime Minister would accept responsibility for resulting judicial reviews. Think about what that means. Judicial review is one of the mechanisms by which the courts hold Executive power within lawful bounds. Yet, on Cummings’ account, the possibility of a court subsequently finding Government action unlawful was not necessarily treated as a boundary which prevented the action. It became a risk to be accepted. Act first. Circumvent the ordinary process. Take the legal risk. If judicial review comes later, deal with it later. Cummings describes officials being told, in substance, to ignore procurement and other rules, with the Prime Minister accepting legal responsibility if judicial reviews subsequently followed. That distinction matters enormously. This is not evidence that Government simply announced: “the law does not apply to us.” It is arguably something constitutionally more sophisticated and therefore more troubling: The machinery intended to constrain Executive power appears to have been treated as an obstacle-management exercise. Rules become friction. Lawyers become obstacles. Legal advice becomes something capable of being overridden. Judicial review becomes an anticipated cost of proceeding anyway. And central authority becomes the mechanism for getting around whatever stands between Government and its objective. That is not how constitutional government should understand the rule of law. The rule of law is not a game in which Government discovers how close it can sail to unlawfulness, presses ahead and leaves the courts to determine afterwards whether it crossed the line. It is the constitutional discipline under which Government itself is governed. Perhaps the most important question arising from this paper is therefore no longer whether Dominic Cummings really meant “ignore rules”. His later evidence gives those words an identifiable administrative architecture. The question now is: How far did that architecture extend, who operated it, what legal obstacles were removed and what happened to those who became obstacles? I know we are only 4 people and you have millions of customers and don't care about just 4, but I think you might discover that a lot more than 4 of your customers are angry about this. Please pressure the government to scrap the law which means huge numbers of food products contain folic acid. *Waitrose and Marks and Spencer - this applies to you too. I'm just not wealthy enough to shop in your stores.

They’re pushing a new mRNA shot because the COVID mandates proved how easy it is to coerce compliance through arbitrary rules. That same compliance is what keeps this nightmare going. Thanks for your attention to this matter.
