“I think, just lastly, to make the point and really echo the message that the IMC has sounded: someone who violates a law, or who is alleged to have violated a law—whether it is someone accused of theft or someone accused of illegally entering a country—does not lose or forfeit their inherent human dignity and human rights. That is why we do not have vigilante justice in South Africa. We have due process in this country, and it applies to every kind of alleged legal violation. A person does not forfeit their right to life, dignity, and humanity simply because they have broken the law or are alleged to have broken the law. That is what our Constitution stands for. It is part of what sets our Constitution apart and part of what makes us a country that the world looks up to. We must never allow a narrative in which people are dehumanised or where there is an assumption that they forfeit their right to be treated as human beings because they have violated, or are alleged to have violated, a particular law. That is the perspective we are promoting and articulating without contradiction. No person has the right to enforce immigration laws outside the authority of the state, demand papers, or demand identification. No person has the right to incite violence. No person has the right to engage in vigilantism. No person has the right to engage in xenophobia or any other discriminatory practice. From a Home Affairs perspective, we take that very seriously because we are ultimately responsible for managing civil registration, population affairs, and immigration in South Africa. We will not tolerate anyone using allegations or suspicions about an individual’s immigration status to violate their inherent human dignity or their constitutional rights.
