Thank you for the insults. My post never disputed the two-element structure. The point is narrower: "perceived bias" appears in operational definitions police use to classify incidents, not in the evidentiary standard at trial. Hate crime data is compiled at the incident level. What gets logged shapes resource deployment, public statistics, and investigative priority long before any Crown applies a reasonable-person test. Under s. 718.2(a)(i), hate motivation requires proof beyond a reasonable doubt as an aggravating factor, agreed. But the Regina Police definition attached defines a hate crime as any offence motivated by an offender's "(real or perceived) bias." That is the lens officers apply at intake, before prosecutorial standards engage. If criticism of a religious accommodation can be subjectively perceived as bias-motivated at the classification stage, it enters the hate crime pipeline on purely subjective grounds. Citizens then face investigation and public logging of their conduct as hate-motivated regardless of whether any charge ever proceeds. That is the concern. Not prosecutions, but the structural effect of a subjective intake standard on open public debate in a free society.
