Neither statement is entirely true a resolution was passed at Congress in 2014 giving MT the authority he used to appoint EM & NC - Mwonzora did not as SG transcribe the resolutions once approved into the constitution & Khupe was removed by the National Council & NC appointed

MDC had a constitution that was violated by both MT & NC. In 2016, MT illegally appointed 2 VPs (EM & NC). NC violated it in 2018 when he illegally took power after MT died. This is the position that was taken by the court. It ordered the party to go back to 2014 structures.

Take Aways From ED's 'Non-Inauguration' & The Way Forward In Resolving The Intractable Zim Political Qn ED's 'non-inauguration' was only attended by a paltry 3 out of 16 Heads of State, which is a powerful diplomatic indication of the extent of the isolation he now suffers from the region owing to the shameless & sham election that he recently held. What Are The Take Aways From That Event? a. Despite the grandstanding, it's clear that ED & his regime have been stung by being snubbed & the isolation that was delivered in full view of a global audience. b. The absence of the SADC Chairperson, President Joao Lourenco of Angola is particularly telling, as are those of the Namibian and Botswana ones, as the regime would have particularly considered them to be strong allies. That absence clearly suggests that diplomatic co-ordination took place & that the strategy of singling out Dr Nevers Mumba when trying to undermine SEOM's Report has spectacularly backfired. c. That development suggests that the diplomatic & political fallout from the SEOM Report continues. It further suggests that there must be behind the scenes manoeuvres that are likely to be launched anytime soon to try and find a soft landing to the crisis. d. In that regard, @PresidencyZA & @CyrilRamaphosa's attendance is likely to be significant. He justified his attendance by diplomatically referring to it as a "working visit". What is more likely is that he used it as a scoping mission to keep lines of communication open, to provide solidarity and to massage the Zim regime's fragile ego to make it easier once the flurry of diplomatic activity begins. e. Whilst its true that Ramaphosa struggles with directly confronting his political adversaries or challenging situations, leading others to accuse him of showing indecision & lacking a political spine, he is nevertheless politically savvy & a pragmatist. f. He knows that the @MYANC faces probably its stiffest political test since the end of Apartheid in the forthcoming national elections & the Zimbabwean question will no doubt loom large over the outcome owing to the massive impact of the millions of Zimbabwean undocumented migrants who cross the border and settle there. Where there was previously a deluge, he can now expect a Tsunami! g. Any diplomatic flurries will take place away from the full glare of the media, to allow for plausible deniability should they turn out to be disastrous or should there be no meaningful breakthrough. We should expect both sides to deny the existence of any such should any leaks occur! h. Despite all the bravado / political grandstanding, ED would have felt humiliated by the snub. Not even the petty diplomatic faux paus of inviting Zambian ex-President Lungu would have lessened the scale of embarrassment & humiliation arising from this. Indeed there are ongoing reports of his regime being on a spree of targeting & persecuting opposition activists nationwide in the aftermath of the results! i. Domestically, ED saw a list of vanquished immediate past female political adversaries in the form of ex First Lady Grace Mugabe & ex-VP Joice Mujuru in attendance. In the case of the former, she even surprised all & sundry by dancing with him but no one was fooled by her antics. It is simply the latest political instalment in a long running game of smoke & mirrors at Zim's equivalent of the Royal Court. j. It represents an opportunistic but necessary symbolism of capitulation and the sinking in of acceptance & reality which needed to be publicly communicated to ED & his cabal almost in Mafia like ritual processes to open the doors for rapprochement and state/regime protection of the highly vulnerable widows and their children from the jaws of a highly rapacious party-state-military industrial complex! k. Publicly, ED & his regime were desperate to present a fait accompli / business as usual image of a juggernaut marching on crushing anything in its path but privately, the gesture undertaken by SADC would have hit home. SADC carefully choreographed the rebuffs in order to signify the seriousness of the situation and to communicate to the regime that it was not backing down or throwing SEOM / Dr Mumba under the bus. l. Despite all the unseemly heckling and public posturing & lynching of Dr Mumba / hullabaloo over the SEOM Report by party apparatchiks, we have not seen ED's regime triggering the formal processes of challenging its contents on a technical / legal level. Objectively speaking, with the FAZ & ZEC shenanigans that we & the global world witnessed in broad daylight, it's a tall order. In any event, this could indicate that the regime is grandstanding for political purposes while privately seeking rapprochement. m. Realistically speaking, once the dust settles and the serious business of governing a country kicks in, it will dawn on ED & his regime the scale of the challenges that he faces. In essence, all key regional and international political and economic offices will be closed or off bounce for him until he cures his huge & unwieldly stain of illegitimacy or is seen to be genuinely attempting to do so. n. From the stolen election, ED effectively has 3 years to serve. This is because, the Constitution limits him to two terms and this is his last term. From that last term, by the time, that he reaches the 3rd year (if he does that is, and that is a BIG IF), power will have shifted and many of his lieutenants will either be openly or secretly plotting against him, rending his presidency a lame duck one! p. From those 3, he won't be able to access "clean" money from reputable multi-lateral institutions due to his illegitimacy. The political & economic cost of authoritarianism is very high and has got a disproportionate cost in International Trade & Economic law vis-à-vis accessing & exploiting trade & investment opportunities in the world economy particularly during a time of such economic turbulence as now which has seen economic stagnation even in China, such a global powerhouse & literally the engine of the global economy over the last decade. r. In addition to this, the Russians & Chinese tend to provide comparatively very small & inconsequential loans such as what we saw with the New Parliament. They also tend to be highly skilled at extractive politics - where they provide diplomatic cover for desperate regimes at the UN & other global forums while exacting maximum economic leverage via shady / clandestine pay back terms in the form of murky mineral concessions where none to very little payment of tax is done. s. Such arrangements hardly develop the national economy at such rates as to eradicate poverty or stimulate real / substantive growth. Russia rarely provides loans. China sometimes does so but on punitive rates and has historically not shown a willingness to loan Zimbabwe substantial amounts due to its poor record of servicing them - although of course a few were advanced for the Hwange & Kariba projects. t. The ADB has been extending loans to Zimbabwe of late but even then - it will have to contend with the increased insurance premiums for covering those loans and corporate / boardroom pressure to minimise "exposure" given the political instability that Zimbabwe is now associated with coupled with the absence / collapse of the rule of law. u. In very short terms, if ED & his regime do not move quickly & with purpose guided by realpolitik to address the self-inflicted political diplomatic stand-off with SADC & @CCCZimbabwe, he will shortly, perhaps in a matter of weeks, be staring at a potential Armageddon / political and economic implosion which will see a recurrence of a run on the currency, massive inflation, erosion of wages, food shortages and disaffection in the security services sector, which is not a good situation given what has been taking place in West Africa in recent times. v. The absence of a two-thirds majority in Parliament will severely restrict ED's room to politically manoeuvre in the long term, (@CCCZimbabwe will naturally need to press home this political advantage without any equivocation - and no - there is no contradiction between securing an honestly earned political dividend and calling the election the sham that it was)! This factor limits ED's prospects not just in relation to his dealings with the opposition outside of his party - but also his internal political opponents - of which there are many and varied as shown by the voting patterns in 2018 & 2023 and the fact that he had to resort to a coup to assume power in both party & country rather that pursue the path of a Congress! Conclusion ED will either have to come off his political high horse and diplomatically engage with both @CCCZimbabwe, @nelsonchamisa and SADC leaders to resolve the impasse or risk getting engulfed in an implosion in a matter of weeks and an impending lame duck Presidency if he lasts that long. Deepening repression when dealing with a limited term in office and your last one for that matter is a zero sum game. Dangerous & highly fluid times for ED & his regime ahead! She does not & can never know my sources. Something can only be deliberately so if it is said or done intentionally, maliciously & recklessly. Reputationally, I can only write something that I am capable of proving objectively. In politically sensitive matters, sources are naturally protected. There is a great deal more that has been shared that will remain unposted. Also reputationally, there is nothing to be gained from posting false information for a person in my position. In fact, there is actually a great deal to lose. As a result of this, I attach a high threshold to what I publish!

You & I know what this country is like. Everything that you have worked for can go down drain in an instant due to ill-judged behaviour. She has got only herself to blame. She will have to prove everything that she alleging on her wall. There shall be no mercy. Another one who is over excited is @SANDEJAQ who, as a Lawyer, should know better. She was previously forced to apologise to Malaba for her recklessness but she clearly has not learned from that saga. I have got a message to my detractors on that score. Shona folklore lands infinite wisdom in that situation: "Ateya mariva murutsva haachatyi kusvipa magaro!" At law we use the Latin expression: "volenti non fit injuria," which loosely translates into, if you voluntarily participate in risky activities, you have to be prepared to bear the consequences. The very act of choosing to opposing the regime is dangerous on its own. I myself have been regularly threatened by the same regime and have disclosed it here. In fact, one Saturday morning, I was woken up by a telephone call from a tearful family member who had been passed the dire warning from the regime. I briefly stopped writing at the time. The message was clear, the regime said it accepted that what I wrote was political analysis but that was irrelevant, it simply did not care. It is a dangerous & ghastly enterprise. It is why I do not dare set foot in Zim even though I do not hold any political office. I know that the stakes are high!

Here is clear evidence of the co-ordinated attacks that were unleashed against me yesterday by Hopewell, Lynne, @mawarirej & @Chofamba, amongst others. Essentially, they weaved a narrative & then set about working the algorithm to devastating effect. Hopewell has got nearly 1 million followers, so you can imagine the impact, in terms of social media impressions. Look at the shallowness of the post! The presumption of knowing my intentions, accompanied by the disingenuous suggestion that Biti's political career thus far wouldn't have been sufficient to get him in ED's crosshairs. This is coming from someone who previously posted on his X handle that he had discussed highly sensitive policy issues surrounding opposition safe houses with Chiwenga after the August 2018 atrocities. Jealousy has worked in the shadows of the state & ZANU PF factions for sometime - the actual documented perpetrators & architects of the current oppressive system. These are our new anti-CAB3 "heroes," who "defend the Constitution" via their vociferous social media activism from the relative comfort of exile. They pontificate relentlessly, identifying, labelling, tarnishing & delegitimising others with reckless abandon!

A report has been filed with South Yorkshire Police this afternoon. I will now let the law take its course. Social media has become a crime scene. The attempts to bully, silence, harass & scapegoat me will not succeed. As I have stated earlier, I will deploy all options available to me to seek accountability. There is no excuse for malice, recklessness, mendaciousness & defamation in a democratic society. Those are my red lines. The Zimbabwean regime is responsible for its own reprehensible actions against all those who oppose it, which I have always condemned unreservedly. It did not start & will not end today!
