17세 소녀가 집 화장실 변기에서 혼자 아이를 낳았다. 가족에게 임신 사실을 알리지 못했고, 남자친구의 도움도 받지 못했다고 한다. 갑작스러운 출산 직후의 충격 속에서 갓 태어난 아기는 변기에 빠졌고, 그대로 숨졌다. 수원지법은 이 소녀에게 아동학대치사로 장기 2년 6월, 단기 2년의 실형을 선고하고 법정구속했다. 판결문은 소녀의 상황을 비교적 정확히 적시한다. “가족들에게 임신 사실을 알리지 못해 제대로 준비하지 못했고, 남자친구의 도움도 받지 못한 상태에서 갑작스럽게 출산했다”고. 재판부가 인정한 사실관계만 봐도 이렇다. 17세가 임신 사실을 가족에게 말할 수 없었고, 임신시킨 남자는 곁에 없었으며, 학교도 의료 시스템도 어떤 공적 안전망도 이 임신을 포착하지 못했다. 그런데 재판부의 결론은 “어머니로서의 의무를 다하지 않았다”였다. 혼자 변기에서 출산한 17세에게 어머니의 의무를 묻고 실형을 선고했다. 임신시킨 남성에게 묻는 책임은 없었다. 임신한 청소년을 어디로도 보내지 못한 사회에 묻는 책임도 없었다. 책임은 가장 어리고 가장 무력했던 사람에게 집중됐다. 이 판결은 한국 사법부가 누구에게 관대하고 누구에게 엄격한지 다시 한 번 보여준다. “앞날이 창창하다”며 성폭력 가해자에게 집행유예를 내주고, 음주운전 사망사고에 솜방망이를 휘두르고, 인종 혐오 폭행에 “폭행 정도가 중하지 않다”고 판시하던 사법부가, 이번에는 17세 소녀의 ‘앞날’을 한 줄도 언급하지 않고 법정구속했다. 영국의 Infanticide Act 1938처럼 출산 직후의 정신적, 사회적 위기를 반영해 별도 죄명으로 분리해 감경하는 입법례가 존재한다. 더 근본적으로 임신한 청소년이 가족과 학교를 거치지 않고도 의료, 상담, 주거에 접근할 수 있는 보호출산제의 실효적 작동, 그리고 임신에 책임 있는 남성 파트너에 대한 법적 책임 부과가 함께 가야 한다. 임신을 알릴 곳이 없었던 17세의 9개월, 그를 끝내 발견하지 못한 모든 시스템, “어머니로서의 의무”라는 말을 17세에게 들이미는 사법의 양심까지 책임이 있다. 재판부는 “사람의 생명은 그 무엇과도 바꿀 수 없는 소중한 가치”라고 했다. 맞는 말이다. 그러나 그 9개월 동안, 이 17세 청소년의 생명과 존엄은 누구에게 소중했는가?
