What? A talking filibuster has not resulted in favorable outcomes for the proponents? (I assume he means proponents of the legislation.) WELL let me tell you a story There are three Senate office buildings. One is named for Sen. Richard Russell and another is named for Sen. Everett Dirksen. John Cornyn has been a Senator since 2003. He has worked in these buildings every day. He also eats lunch in the Mike Mansfield room a least each week. Did he ever stop to ask how those places got those names? Let me tell you, spoiler, it involves the longest filibuster in history and it worked out well for the proponents. Richard Russell was a southern democratic opponent of the civil rights act of 1964. Mike Mansfield was the Democratic majority leader and a proponent of the bill. Richard Russell was a the Republican minority leader and a proponent of the bill. After a 60 day talking filibuster, the standoff ended with a 14 hour speech from Senator Robert Byrd who was amongst the southern democratic opponents of the bill. The proponents had finally won enough votes to end the stand off and pass the bill. Cornyn serves in buildings/rooms named for the key players in one of the most dramatic talking filibusters in history, which ended well for the proponents, and he never stopped to consider this history which is right in your face on the Senate campus? Even wilder, Cornyn served with Robert Byrd for 7 years and with three other Senators who were part of the 1964 talking filibuster fight, and he doesn’t know this? This isn’t ancient history to him. He knew these people. It did not go well for those filibustering, but it worked out really well for the proponents of the legislation. And every single person in the Senate knows at least some of this history. Wild that Cornyn doesn’t know how the Senate works after being there 24 years.

Justice Kennedy decided that “evolving standards of decency” render unconstitutional the death penalty for child rapists. Sadly, he wasn’t wrong at the time. Standards of decency went through the floor from 1968-2024. Hopefully standards will now “evolve” in the opposite direction.

Where did the ban on death penalty for child rapists come from? Justice Kennedy wrote Kennedy v. Louisiana, which found in 2008 that "evolving standards of decency" prohibit death penalty for those cases. Well, it's been 20 years since then. Perhaps standards have evolved again

.@JohnCornyn, your memo perfectly illustrates why the talking filibuster is necessary—not why we should avoid it like the plague or pretend it doesn’t exist. The procedural hurdles you list (including the two-speech rule, quorum, calendar drag, and opportunity costs) are real. But they’re also manageable—and in many instances can even be used to strengthen our negotiating position—if Republicans actually use the rules instead of surrendering to them. The alternative—walking away from the SAVE America Act—has far higher costs: another election without proof of citizenship, more erosion of public confidence, and Democrats continuing to weaponize the same procedures against us. We can hold quorum. We can manage the two-speech rule. We can prioritize. The Senate should turn immediately to the SAVE America Act, debate it, and pass it. Election integrity isn’t optional and it isn’t going away. Let’s do the work. Let’s save America. Let’s pass the SAVE America Act!

For people who don’t know - the fight over the ‘Save Act’ is really about the filibuster. The Act would secure elections - making the kinds of fraud we all suspect much harder. You would need ID etc. If the GOP introduces the bill for a vote, it will face an immediate filibuster from democrats - who benefit from shady voting systems. The GOP cannot get together a majority to eliminate the filibuster - they cannot accept that the left is going to eliminate it at the first opportunity, and don’t want to go first. Maybe some GOP types also just don’t like the Save Act for whatever reason - but most of them are not against the substance. They are ‘standing on principle’ about the filibuster - as if there are any principles left in a world in which democrats openly talk about adding senators through making Puerto Rico and DC states, then packing the supreme court, then eliminating the electoral college.

The fall of Rome was less a dramatic collapse and more the slow and eventually total decline of state services. One day, your postman becomes a little less reliable. He arrives less often. Then later on, he's gone, and you're not sending or receiving letters anymore.
