I wrote an article in Stanford L Rev in 2000 about why not proprtize personal data & one in 1997 in Vanderbilt on no IP in data
There is probably good scholarship from the mid-90s when the EU adopted the Database Directive, and early 2000s when US considered doing the same, on the problems specifically with treating tiny increments of back-end data as property. (Those laws weren't about privacy, just IP.)
