If it wasn't AI but was a real child, then claiming the perp thought it was AI would likely not be a defense. It is not a defense to cp charges or to statutory rape for the perp to claim that the perp reasonably believed the victim was of legal age, even if the victim displayed an ID purportedly demonstrating that.
