How big does a project have to be before New York requires an environmental impact statement? For some projects, there is no number. Yesterday, DEC sent FERC its demands for the revived Constitution Pipeline. The list: — A full environmental impact statement — DEC says the lighter-weight review FERC proposed is legally "unreasonable" — A brand-new water quality certification application — the same permit DEC used to kill this pipeline in 2016 — Updated endangered species surveys, migratory bird surveys, bald eagle surveys — Blasting impact analysis, invasive species controls, wetland re-classifications — Answers to every outstanding environmental information request before FERC may act DEC's justification: roughly 500 acres of forest disturbance, 80 acres of wetlands, 300+ stream crossings along the 125-mile route. Now drive to Elba and Oakfield in Genesee County, where the state permitted Cider Solar. It spans 2,452 acres, five times the forest impact DEC is citing, the largest solar project in New York's history. Environmental impact statement? None was required. Not because regulators decided it wasn't needed, but because the solar siting law New York wrote in 2020 makes it impossible to ask. Section 94-c projects are exempt from SEQRA. Endangered species, wetlands, and forest clearing are handled with checklist conditions in a permit. DEC's role is reduced to filing comments. Cider Solar will supply about 35 intermittent hours of New York's electricity per year — a day and a half — across 2,452 acres in Elba and Oakfield. The Constitution Pipeline's 500 acres of forest impact would carry enough gas to generate roughly 60 to 80 days' worth: fifty times the energy on a fifth of the land. It's the pipeline that gets the full environmental review.

@HillaryClinton In 2000, the AAP recommended that high-risk infants (e.g., those with family history of allergy or eczema) avoid peanuts until age 3, with similar delays for other allergens, & suggested maternal avoidance during pregnancy/lactation in some cases. Turned out a bad recommendation.
