Federalism concerns: The Foreign Contribution (Regulation) Amendment Bill, 2026 ranks among the highest-priority items for diversion The bill establishes a statutory Designated Authority empowered to take provisional and permanent control of foreign contributions and assets of any organisation whose FCRA registration is cancelled, surrendered, expires without renewal, or is refused renewal. Asset vesting can occur through an administrative process. It also widens personal liability of key functionaries, imposes utilisation timelines, and requires prior Central Government approval before state agencies can initiate FCRA investigations. It expands the state’s capacity to interrupt the financial and asset base of a large class of civil-society organisations that receive foreign funding. The categorical boundary being redrawn is the one between “regulated foreign charity” and “assets subject to state seizure and management upon loss of licence.” It treats foreign funding as a potential vector of political or ideological influence that requires tighter state custody. Many organisations that have historically operated in the domains of human rights documentation, minority welfare, environmental advocacy, and critical research rely on foreign contributions. Expanding the state’s ability to take over their assets upon administrative cancellation raises the cost and risk of sustained adversarial activity. This alters the relative power balance between the state and non-state actors that can generate alternative narratives or mobilise international attention.
Prevention of Insults to National Honour (Amendment) Bill, 2026 Listed for introduction/consideration in Rajya Sabha around 20–24 July; debate disrupted and scheduled to resume 27 July. Extends the 1971 Act’s protections to Vande Mataram, criminalising insult or disruption with up to three years’ imprisonment or fine. This shifts the categorical boundary between cultural symbolic expression and criminal liability. It enlarges the state’s coercive repertoire over speech related to national symbols.
Supreme Court (Number of Judges) Amendment Bill, 2026 Introduced in Lok Sabha on 20 July. Raises the number of puisne judges from 33 to 37 (total strength 38 including the Chief Justice). Replaces a May 2026 ordinance. This expands the capacity of the apex court. In systems terms (my lingo) this alters the relative power balance between the executive and the judiciary by increasing the pool of adjudicators available for constitutional and high stakes litigation.
