[2조 원의 국부를 지킨 국제분쟁 최전선의 수호자들] 대한민국이 또 한 번 국제투자분쟁(ISDS)에서 완승을 거뒀습니다. 최초 청구액은 약 2조 원에 달했습니다. 이 막대한 국부를 끝까지 지켜냈습니다. 이번 취소 절차에 들어간 비용과 이자까지 펑전 민 측이 부담하게 됐습니다. 중국인 투자자 펑전 민은 중국 베이징의 건물 매입을 위해 국내 회사를 설립하고 우리 금융기관에서 수천억 원의 PF대출을 받았습니다. 이후 대출금을 갚지 못해 담보로 잡힌 회사 주식이 처분됐고, 이를 둘러싼 국내 민사소송에서도 패소했습니다. 대출 과정에서 금융기관 임직원에게 금품과 이익을 제공한 사실로 형사재판에서 유죄판결까지 확정됐습니다. 그런데도 펑전 민은 한국의 민·형사 사법절차가 한중 투자협정에 위반된다며 대한민국 정부에 거액의 손해배상을 요구했습니다. 적반하장도 이런 적반하장이 없습니다. 우리 정부는 단호하게 맞섰습니다. 불법적인 투자는 투자협정의 보호 대상이 될 수 없다는 논리였습니다. 결국 원 중재판정부가 우리 정부의 손을 들어줬고, 이번 취소위원회 역시 취소신청을 전부 기각했습니다. 이 결과는 그냥 나온 것이 아닙니다. 법무부 국제투자분쟁과를 중심으로 국제법에 전문성을 갖춘 검사들과 관계부처 실무진, 국내외 로펌과 전문가들이 긴밀하게 협력했습니다. 2020년 ISDS가 제기된 이후 6년 넘게 방대한 기록과 증거를 검토하고 대응 논리를 다듬으며 국제중재 법정에서 치열하게 싸웠습니다. 자료 한 장, 논리 한 줄을 끝까지 파고든 그 노력이 결국 수조 원의 국가 재산을 지켜낸 것입니다. 총성이 울리지 않는 전쟁도 있습니다. 국제중재 법정에서 수조 원의 국부를 지켜내는 싸움입니다. 론스타 사건에 이어 쉰들러 사건, 이번 중국인 투자자 펑전 민 사건까지 대한민국의 국제분쟁 대응 역량은 이제 분명한 성과로 증명되고 있습니다. 이런 일은 크게 칭찬해야 합니다. 2조 원에 가까운 국부를 지켜낸 법무부 국제투자분쟁과와 관계부처 실무자 여러분, 정말 고생 많으셨습니다. 이분들 정말 상 줘야 합니다. 국회의원이기 전에 대한민국 국민의 한 사람으로서 정말 든든하고 자랑스럽습니다. 고맙습니다. naver.me/FAAoIRhs
