Michael as a defense attorney who defends against 2A abuses by Law Enforcement against legal carry citizens how would you break down Pretti’s actions? He had a legal right to carry and did not draw his weapon and appeared in compliance. If he was not tragically killed and he was your client what defense would you deploy? I ask because I too have a PA carry permit and feel the actions of ICE make it difficult for me to feel comfortable carrying at all and that my life would be in mortal danger regardless. This action by ICE has a chilling effect and Federal Gov power grabbing. How do you feel?

I see Nurse Pretti as not interfering with ICE, rather observing their actions and providing a medical evaluation of another observer. I see ICE using overwhelming subduing force against a citizen who is observing and exercising their constitutional rights. ICE never defined the area in question as a crime scene or area of control with defining markers. Too me it seemed that ICE was in a retaliation mode and not in deescalation mode, which indicates that their mission has no element of public safety and indicates lack of a cohesive command and control of the area and possibly of the whole mission.
