Husbands: maintenance is not calculated by looking at your salary and dividing it by some magic number. And no, there is no universal rule saying: ₹1.5 lakh salary = ₹30,000 maintenance. The Supreme Court has explicitly said there is no straitjacket formula for determining maintenance. So what does the court actually look at? 1. Your actual income Not just CTC. But, salary slips, salary certificate, Form 16, ITRs and actual bank credits. If you're self-employed/business owner, disclose the actual business income, liabilities and relevant financial statements. 2. Your wife's actual financial position Her income, assets, investments and other sources of income are relevant. Don't simply assume that "she isn't earning." Put the actual financial position before the court. 3. Your genuine liabilities Existing loans. EMIs. Mortgages. Legally dependent parents/family members. Child-related obligations. Other genuine financial commitments. But remember: merely having an EMI doesn't automatically mean the court must deduct it rupee-for-rupee. The court examines the nature and genuineness of the liability. 4. Standard of living Maintenance is intended to provide reasonable support consistent with the circumstances and standard of living of the matrimonial household - not to create either destitution or an oppressive financial burden. Why is it given even in shorter marriages of a few months is another story. 5. Children and dependants Their education, medical expenses, food, clothing and other reasonable needs can materially affect the calculation. 6. Existing maintenance orders If maintenance has already been awarded under another proceeding, disclose it. Don't expect the court to calculate your liability accurately if it doesn't know what has already been ordered or paid. And here is the part many people completely miss: DOCUMENT EVERYTHING. Keep ready: • Latest salary slips • Salary certificate • Form 16 • ITRs • Bank statements of all accounts - typically 3 years • Investment statements • Property documents • Loan sanction letters • Current loan statements • EMI payment records • Insurance/medical obligations where relevant • Proof of genuine dependent-family expenses • Existing maintenance orders • Proof of maintenance already paid • Business financial statements, if self-employed • Evidence of income from rent, investments, dividends, etc. The Supreme Court's Rajnesh v. Neha framework specifically requires disclosure of income, expenditure, assets and liabilities. And there is a reason. A maintenance order should be based on the complete financial picture - not assumptions, exaggerations or incomplete disclosures. There is also an important warning for husbands: Do NOT hide income. Do NOT submit an incomplete affidavit. Do NOT deliberately withhold salary slips or bank statements. Courts can draw an adverse inference from non-disclosure. In fact, the MP High Court recently set aside a ₹30,000/month maintenance order in a case where the Family Court had assessed the husband's income at ₹1.5 lakh but had not properly dealt with his failure to produce salary documents. And while 25% of net salary has appeared in Supreme Court jurisprudence as a benchmark in particular cases, it is not a universal mathematical formula. The real formula is: Actual income + actual needs + independent income + dependants + genuine liabilities + standard of living + complete financial disclosure = informed judicial assessment. So don't enter a maintenance case thinking: "The court will just take my salary and pick a number." Enter it with documents. Because when money is the subject of litigation, your paperwork is your financial autobiography. And the court can only calculate what the evidence actually shows. Remember the case of Manav Singh. Bhavleen Kaur falsely accused him of sexual harassment on her Instagram stories. After that, she posted another story and said that it wasn't her fault that he couldn't handle the pressure. She even made fun of him and was very happy about his death. Manav took his own life. She didn't face any punishment. Didn't go to jail, didn't even come in the news. And today, just look at her life. Travelling, making reels, having fun and living her best life. An innocent 17 year old boy lost his life because of her. Nobody cares when it comes to men. So many men lose their lives because of false accusations, but nothing changes.

Another case today.. Just now got the update from my friend. The Interesting one… 2 Crore Alimony to 1 Crore now : There was a mediation at the High Court today. It was second day . The wife came down from ₹1.7 crore to ₹1 crore. The husband was laughing. 😂 Then the wife started crying in front of the mediator: “Look, my husband filed a custody case during the mediation. This is a backstab to the mediation.” The mediator also told the husband: “You have committed fraud against the mediation process. You don’t file a case in the middle of mediation like this.” After the mediation, the IO from the 498A case called the husband: “You are filing a case? She wants to settle.” The husband said: “She is asking for ₹1 crore in exchange for letting the husband meet his own child.” The IO went silent. 😂 Then the wife said: “I will never let him meet the child. And I will never allow unsupervised meetings.” The husband simply said: “Time will tell.” Then he told the mediator: “Look at this. She is turning the child into a transaction, and you are calling me a fraud?” “The child’s biological father is still alive. What kind of mother tries to use her own child to extort money from the father?” The wife started crying again. 🤭 Then came the list of complaints: “He got our flat case disposed of…” “He is not giving me my jewellery…” “He has filed a custody case…” “And now he is being petty here as well…” So apparently: Filing a custody case to meet your own child = backstab. Getting a case disposed of = problem. Not handing over ₹1 crore = chindi pana. 😂 And the funniest part? The wife had already come down from ₹1.67 crore to ₹1 crore. Yet somehow, the husband was the one being called petty. 🤭

UPDATE ON HIS CASE Just came back from Family Court. The mediator saw the wife entering the room and took a deep breath. He stood up, went outside… and came back after almost half an hour. Most probably, he knew his head was going to bust today. 😂 Then the drama started. Mediator: “Madam, what’s the plan?” Wife: “Hmm…” Mediator: “Yes, tell us.” Wife: “My jewellery is with him. Please help me get that.” Mediator: “That we will see at the end. First tell us, what have you decided? Are you going back with him?” Wife: “No. That is not possible. He beats me.” Mediator: “Okay. Then you want separation?” Wife: “Yes! That’s why I filed for divorce. When will I get it?” Mediator: “Do you know the process?” Wife: 🤔 Mediator: “Do you want to contest the divorce?” Wife: “I don’t know.” Mediator: “We are here to mediate and close the matter by putting an end to all allegations.” Wife: “Okay.” Mediator: “Any demand?” Wife: “Yes. I already told you — ₹1 CRORE ALIMONY.” Mediator: “Okay. So no change?” Wife: “I am… blah blah…” Then the mediator turned to the husband: “You want to say something?” Husband: “I’m fine with ₹1 crore.” Mediator: 😳 “What?” Husband: “Yes. She is so rich and highly earning. She can easily afford ₹1 crore.” Mediator got completely confused. Mediator: “Are you saying you want ₹1 crore, or you are ready to give ₹1 crore?” Husband: “How can I give it? Last time I already told you I earn only ₹50,000 a month. It would take me almost 20 years to make ₹1 crore. I didn’t ask for divorce. She asked for it, and I respect her decision. She is my wife. She is an empowered, highly educated, highly earning woman. So she can easily afford giving ₹1 crore to the husband she is ditching.” 😂 Mediator turned to the wife: “Madam, you want to say something now?” Wife: “He is making a joke of me.” Mediator: “You both are making a joke of us.” He closed the file. “I am closing this mediation and sending the matter back to court. You both take ₹1 crore from each other and fight in court for the next 10 years.” He wrote something, closed the file and walked away. MEDIATION FAILED. 🤦‍♂️ The reader initially gave the next date as 5 January 2027. The wife started shouting and arguing. The reader said the date had already been given by the judge and asked her to please wait. She went near the judge and waited for her turn. Judge: “Yes, madam?” Wife: “Reader sir has given a very long date. Please give a short date.” Judge looked at the calendar. Judge: “14 February.” Wife: “Hmm??” Judge: “jao.” She silently walked away. 😂 So now the next date is 14 February 2027. Outside the court, I told the husband: “Now you know why I said — NEVER FILE DIVORCE.” This is the judicial circus. They won’t give relief to anyone — neither you nor your wife. You wanted divorce? Mil gaya teri biwi ko divorce. 🤭🤭🤭 Well… Not exactly. Because after all this drama, they are still going back to court. Enjoy now. 🤭

Tip of the day: Never go to a police station merely because a police officer calls you. There is a clear judgment of the Supreme Court on this. For offences punishable with less than 7 years’ imprisonment, arrest is not supposed to be the first step. The police are required to issue a notice of appearance under Section 41A CrPC where applicable. So don’t walk into a police station just because someone says, “Come over for a few questions.” Always ask the officer to issue a written Notice of Appearance instead of relying on a phone call. Know your rights before you enter the police station.

India is standing with the top leadership of Russia and China. But does India really think about what exactly these countries are doing with their men? And what is India doing with its men? China has recently moved against the concept of alimony. Taxation in China is relatively low. The development of Russia and China is there for everyone to see. So while India is standing with their leadership on the world stage, why doesn’t India also look at what these countries are doing internally? Why not learn from what works for their men, their families, their economy and their development? Standing with them is not enough. India should also learn from them.
