The Attorney General repeatedly presents as “facts” propositions that are, at best, vigorously disputed and, at worst, unsupported by any Virginia-specific evidence. The motion declares that AR-15s are “not in common use,” despite the fact that they are among the most commonly owned rifles in America. It labels them “dangerous and unusual” while acknowledging they are possessed by millions of law-abiding Americans. It characterizes them as weapons “most useful in military service,” even though the AR-15 is not the standard service rifle of the United States military. And it invokes the specter of mass shootings without identifying Virginia data showing that AR-15s are responsible for any measurable pattern of such crimes in the Commonwealth. Virginia does not even maintain publicly reported homicide statistics by firearm model, making sweeping factual assertions about AR-15s impossible to substantiate with state data. These are not established facts—they are disputed propositions that go to the very heart of the litigation. Courts exist to resolve contested facts and apply the law, not to accept a lawyer’s characterization of those facts This is what happens when the top lawyer for the state is a guy that can’t spell Virginia. The biggest problem with Warsh hearing is discussing inflation without a clear understanding of what the word means. If you incorrectly define inflation as rising prices instead of an expansion of the supply of money and credit, any discussion that follows becomes meaningless.
