As a cynic and contrarian I’m always a beer or two away from a good conspiracy. I’ve learned during the Trump era that the difference in a good conspiracy theory and the truth is about a year. So here goes…… As we celebrate our independence let it be known that after The Civil War a select group of elite and northeastern historians got to write the history. It wasn’t good enough to paint the confederacy as ONLY racist and ONLY fighting to preserve the disgusting institution of slavery. They saw this as their chance to rewrite the history of The Revolutionary War as well and diminish the south’s contribution to victory. And they did. Our independence was not won in Boston or New York but rather in the backwoods of South Carolina. Sam Adams and Paul Revere were badasses but so was Francis Marion. The south is where the Revolution was won 250 years ago and while General Cornwallis surrendered at Yorktown, it was after he got his ass whipped in the Palmetto State.

Several ways forward here given the choice of Roberts/Barrett to nullify the 14th Amendment and extra-constitutionally replace it with their own language: 1) Nullification. States issue birth certificates, and they can just stop issuing them to non-citizens. Roberts/Barrett can deal with the fallout and litigate each birth individually. 2) Pack the court. If Robert wants to be a politician who writes laws instead of a judge, then he can fight with 10 more unelected legislators in robes. 3) Deny entry to all pregnant foreigners. 4) Deny entry to all female foreigners. 5) Require sterilization of all foreign visitors prior to entry. 6) Dissolution of the Union. A nation which can’t even restrict who gets to be a citizen isn’t a nation. 7) Amend the Constitution. This is pointless, because once a judge decides he can rewrite the Constitution at will (as Roberts and Barrett did today), the actual text is meaningless. But this is what most GOP politicians gravitate towards because they are useless. If you think all these options are not great, understand that that is what happens when unelected judges decide that they are in charge of the country and get to write its laws.

Imagine if basketball games were played inside locked buildings without windows. The field goals and free throws were registered and counted by machines. The running score of the game was projected on the outside of the building. But it wasn't simultaneous with the game. The running score changed for days and even weeks after the contest was over. When at last there was a final score the fans cheered or slumped in despair. How long would public interest and faith in such a sport last?
