The Asymmetry of Rights: There in no Equality Before the Law for the IMF 1. Section 5 of the Bretton Woods Agreements Act of 1963, as read with the Schedule to the Act, creates an impermissible asymmetry before the law. Fund Agreement Article IX, Section 2 gives the IMF full juridical personality, including the capacity “to contract,” “to acquire and dispose of immovable and movable property,” and “to institute legal proceedings.” 2. However, Article IX, Section 3 then provides that the Fund, its property and assets enjoy “immunity from every form of judicial process,” except where the Fund expressly waives immunity. 3. The result is a one-sided legal relationship: -The IMF can sue Kenyans in Kenyan courts. -Kenyans cannot sue the IMF. -The IMF can contract, own property, and enforce rights in Kenya. -Kenyans cannot enforce rights against the IMF. 4. This asymmetry offends the constitutional principle of equality before the law. Article 27(1) provides that “Every person is equal before the law and has the right to equal protection and equal benefit of the law.” 5. Equality before the law is not satisfied where one legal person may invoke the protection of Kenyan law but is placed, by ordinary legislation, beyond the reach of constitutional scrutiny. 6. A statutory regime that allows an international institution to sue, contract, own property, and enforce rights in Kenya, while denying affected persons and constitutional organs effective access to judicial process, creates a one-sided legal relationship that cannot be justified under the Constitution. #DeniBandia #OdiousDebt

One thing that upset Uhuru about 8.4.4. was how easily children of nobodies got education, up to university. The man did not like Kibaki's free education policy. He is not down to earth, not by a long stretch. And Matiang'i shared that madharau and viciously fought against Kenyans working their way into university. Not only did he massively fail children, he also wanted to withdraw degrees earned by people who entered university through diploma programs. He introduced publication requirements for PhD, increasing the amount of vanity publishing. And then, of course, he brought CBC that introduced a second layer of secondary school, so that JSS became the cliff over which children fall and end their education for good. The reason why Kenyans are blind to what happened to their children is that all this war on education was justified as a concern for "quality" and "honesty." I even asked: do we realize what we are saying, which is that failure of children is something to celebrate? The idea is so racist, because it basically suggests that nothing is good if it has Africans in it. But the Uhuru/Matiang'i PR machine was so loud, it said that I was endorsing cheating and Kenyans believed it. Uhuru and Matiang'i did a lot of damage to education and the Kenyan mind. A lot. The Court upheld the @IMFNews claim of diplomatic immunity and struck it out of this petition. While we respect the Court’s decision, accountability for Kenya’s debt burden cannot end there. We are preparing a separate legal challenge to the Bretton Woods Agreements Act, 1963, against the Constitution of Kenya 2010 to ensure all actors involved in Kenya’s debt processes are subjected to proper scrutiny. Most importantly, the Court rejected attempts by the Attorney General and other respondents to have this case dismissed. The judges ruled that our petition will proceed to a full hearing on its merits. The Court also dismissed applications by the former Auditor General, former Controller of Budget, the current Auditor General, and the current Controller of Budget seeking to shield themselves from these proceedings. This is a significant victory for transparency, accountability, and the Kenyan people. We will amend our petition as directed by the Court and return on 22nd July 2026. Our mission remains unchanged: to establish how Kenya accumulated trillions in public debt, how the funds were utilized , whether the public benefited and whether the law was followed at every stage. This case is about protecting the future of our nation and the interests of every Kenyan taxpayer. We remain focused, determined, and committed to seeing it through. It killed people precisely because it refused to recognize their constitutional right to demonstrate, now it uses the blood of those same people to "remember the lives WE lost." Who's "we" here? Today in the @Senate_KE, I will substantiate how public money is being hidden and stolen in plain sight through budget lines labelled “Other Operating Expenses.” OVER 90 BILLION! If salaries, utilities, travel, maintenance, fuel, training, procurable items, and other expenditures already have specific vote heads, what exactly is hidden under this vague and ever-expanding category? Even more troubling, the Constitution requires parliamentary approval for all public borrowing. Yet billions are spent under opaque budget lines that escape meaningful scrutiny. Kenyans deserve transparency, not blank cheques for wastage, mismanagement, and theft. Every shilling collected from taxpayers must be traceable, justified, and accounted for. Kenyans deserve justice that is transparent, reasoned, and accountable. Today, I have petitioned the Judicial Service Commission @jsckenya to investigate three Court of Appeal judges who suspended High Court orders blocking the Kenya-US Health Cooperation Framework, but withheld their reasons for doing so until October 2026. My concern is not that they ruled against me. It is that an immediately enforceable decision was issued without reasons, effectively frustrating a timely appeal to the @THE_SCOK and denying Kenyans meaningful access to justice. Judicial independence must be protected. But independence and accountability must go hand in hand. No institution is above the Constitution. I'm reading about how the British, in the early 1900s, used to confiscate livestock in Turkana numbering 5,000, up to 16,000. And then when the Samburu raided the Turkana for 300 heads of cattle, the British fined them. Yani, it was ok for the British to steal cattle but not for other Africans to conduct cattle raids. Of course, the math wasn't mathing. The Turkana successfully staged a tax boycott against the colonialists, until the colonialists had to withdraw the tax. But in 1915, the British confiscated a staggering 130,000 head of cattle from the Turkana and killed over 400 warriors. Towards north eastern, the British used to confiscate livestock of Kenyan Somalis so that Europeans breeds would dominate the region and Somalis would be rendered poor due to loss of livestock. The British hated pastoralism (@m_ogada often reminds us that the wazungu and GoK still do) because it made the communities difficult to control, to reduce to forced labor and extract taxes from. So they attacked their livelihoods. And they brought rinderpest. Northern Kenya was governed as "closed districts." People from those regions were not allowed to leave without permission from the colonialists. The act was repealed in guess when? 1997. Yes. And then I remembered Huduma Namba and SHA in which the government proposed means testing, where people's ID cards and SHA contributions included data on the livestock they owned. What I feel reading this is a mixture of anger and horror at that level of looting, surely. And anger that GoK can still be thinking like this in the 21st century. Between the 1960s and the 1980s, under the guise of "countering Communism," the CIA infiltrated Christian movements all over Africa and the Global South with the mission of steering Christian doctrines away from so-called "Liberation Theology" (teachings that encouraged people to stand up to corrupt governments and take collective action to better their lives), because this doctrine apparently was "Communist." It funded and assisted the explosive growth of a whole new form of Christianity, which you recognise today as Prosperity Gospel, and it pumped millions of dollars into pushing it all over the Global South as part of its Cold War effort. This new doctrine ignored any kind of collectivism and encouraged people to see their Christian faith and salvation as individualistic issues that can be measured with specific individual outcomes, such as economic "blessing." It was the perfect capitalist trojan horse because it convinced people to stop thinking of progress as a shared national issue and rather as an individual responsibility, which meant they did not need to organise into pressure groups, political movements, trade unions, student unions, or any other collectivist entities that the US government considered "Leftist" or "Communist." It succeeded wildly, and turned the world's poorest people in Sub Saharan Africa into rabid, money-obsessed capitalists without capital. And in case you're wondering whether this means that all your mega pastors in Lagos and Abuja are US government-funded industry plants, the answer is simple: do a 1-minute Google search and find out where they all gained their theology degree or pastor training. There's your answer. Anyway this is all on open record on the FOIA section of the CIA's own website, but the oyibos have convinced you that "Africans don't read," and you have internalised your own false stereotype, so you definitely won't read regardless. It's too late, I'm afraid. The problem is that the neoliberal ideology of CBC is in our bloodstream. Kenyans believed the ideas behind CBC at least a decade before CBC was implemented. They are unwilling to challenge those ideas about 1. learnification 2. potential and talent 3. "practical" skills without knowledge 4. rote learning as evil 5. Exam obsession as a curriculum problem 6. teachers are being retrained Whenever I say these ideas are dangerous, Kenyans start singing about the need for consensus and for respect of others' opinion. But the goal of opinions is not respect. It's understanding the issues and expanding the mind. But this equation of opinion (what we think about something beyond ourselves) with identity (who we are) allows Kenyans to avoid the issues, as they ironically claim we are in a new era of critical thinking. We have to excavate that ideological rot before we can clean the tooth and Kenyans understand why the system is bad. And the people defending these rotten ideas are the educated and the middle class, because the foundation of those ideas is extreme individualism. The rural people deliberately undereducated by the government are just trusting that somehow, the chaos might sort itself out in the end. But middle class Kenyans won't budge, and they run the media, the academy, the government and the church repeating these bad ideas. The hold of these institutions on the Kenyan collective psyche is so strong, I'm sure the US rubs its hands in delight every time it's thinking of how to spread a neoliberal poison in Africa. Kenya is deeply drowned in it. In my chapter on the Education Alibi, I explained that when it comes to CBC, we're in the zone of gaslighting and cognitive dissonance. Yes, I used those exact terms and explained how they work. I didn't use them metaphorically. We've been gaslighted, sadly. #CBCisheretostay
