🇰🇷 President Yoon Suk Yeol’s Closing Statement Over the course of the election related lawsuits, significant evidence of fraudulent ballots has come to light. As recently as the second half of 2023, just over a year ago, a National Intelligence Service security review found that the National Election Commission fell well short of the basic standards expected of a state institution and was highly vulnerable to external hacking. The electoral system is the bedrock of representative democracy and its constitutional order. The story of democracy is fundamentally the story of protecting and securing the right to vote. In any liberal democracy, election administration must be completely transparent and free from any reasonable doubt about its fairness. Yet the National Election Commission refused to allow transparent and impartial verification. Given the deep public concerns about election integrity and how vital it is, the decision to conduct such an inspection was both reasonable and necessary. Fair elections are the foundation of national unity. They are also essential to national security and prosperity. That needs no further explanation. Did this undermine the constitutional order? Did it incite a riot? To accuse those who implemented or supported the lawful execution of the emergency martial law declared by the President in full accordance with the Constitution of any wrongdoing is nothing but baseless speculation and political fiction.

The investigation conducted by the Corruption Investigation Office for High-Ranking Officials is also unlawful. These views are backed by a majority of constitutional scholars and legal experts. However, the first-instance court ruling failed to provide sufficient grounds or explanations to overturn these claims. To deny President Yoon Suk-yeol is to deny South Korea’s liberal democracy. 페이스북 게시물 전문: facebook.com/share/p/1FUqwx… 우리들 삶에서 기대는 늘 배반당하기 십상(十常)이다. 오늘 선고된 윤석열내란재판에서 정의로운 판결을 기대했지만 결과는 정반대였다. 푸시긴의 시귀처럼 삶이 또 우리를 속였다. 분노는 하되 좌절은 말자. 아직 2심, 3심이 남아 있고 주권자인 국민의 의지가 있다. 지금은 정치권력의 선동에 흔들리고 있지만, 물결이 수평을 찾아가듯 국민여론도 끝내는 진실과 정의를 향해 변화할 것이다. 이를 믿으면 된다. 내란은 우리 형법상 가장 무거운 범죄다. 국헌문란의 목적과 폭동이 그 구성요건이다. 이 구성요건은 구체적 사실과 엄격한 증명이 있을 때 충족될 수 있다. 이것이 불변의 법리다. 재판부는 대통령이 병력을 국회에 보낸 것 자체로 국회를 공격한 것이며 이로써 내란목적을 인정할 수 있는듯이 말한다. 또 병력파견이 곧 폭동을 의미하는 것처럼 인정한다. 그러나 국헌문란이란 근본적으로 헌정체제를 부정하거나 반대하는 것을 전제로 한다. 그리고 폭력을 동원해 나라 전체나 일부 지역을 혼란에 빠트리는 난동, 즉 폭동이 있어야 한다. 윤석열의 비상계엄에 그런 목적과 폭동은 없었다. 시작부터 끝까지 모두 TV로 생중계되었으니 무슨 설명이 더 필요할까!극소수의 비무장병력이 개미새끼 한마리 다치지 않고 2시간 남짓 국회에 머물다 철수한 것이 전부다. 고양이를 가리켜 호랑이라고 우기면 호랑이가 되는가! 국회 절대다수를 무기로 탄핵, 특검을 남발하고 예산권을 남용하여 일부 정부 기관의 기능을 마비시키는 등의 민주당 폭거에 시달리던 윤석열이 정상적인 헌정질서를 위한 목적으로 비상계엄을 발포한 정황만 분명히 드러났다. 전에도 말했지만, 윤석열의 어설픈 비상계엄이 직권남용이나 계엄법위반은 몰라도 내란을 구성한다는 것은 언어도단(言語道斷)이다. 재판부의 논리대로라면 앞으로 어느 대통령이 군대를 동원해 국가위기를 극복하는 비상계엄을 발포할 수 있겠는가! 오늘은 부끄럽고 수치스러운 날이다. 그러나 이것이 우리의 허약한 민주주의의 실상이다. 더 강한 민주주의, 더 튼튼한 민주공화정을 위하여 새롭게 출발하는 오늘이 되어야 한다. 이를 위해 각자 서있는 자리에서 저항하고 또 투쟁하자!
