We understand that Native Americans - not just those on reservations but "the wild Indians of the Plains," as they were referenced in the debates - were excluded because we know history. They were explicitly excluded from the Civil Rights Act. They were explicitly excluded from Section 2's apportionment formula. Their exclusion from American citizenship was a matter of universal agreement in the congressional debates on the citizenship clause, and was mentioned not in one or two offhand remarks but pervasively throughout them. The understanding that the tribes were distinct domestic sovereigns whose status was unique in American law was deeply-rooted in American politics & law by 1866, two years before the Treaty of Fort Laramie. The Thirteenth Amendment has exceptions not explicitly spelled out in the text. To learn them, you study history of what was recognized previously under the Northwest Ordinance. But courts properly resist reading them expansively because they're unenumerated. The same is true of the Citizenship Clause. The only serious debate is over what those were understood to be at the time.
