@StockJabber Not sure I'd characterize it as the government clearly caring about it so much as NOT doing it can provide an opening for your disclaimer to be ignored by regulators and courts. It's a subtle distinction but an important one.
My take is that the standard "affiliates may have positions" language may be insufficient or unwise even if short activists know that means balance sheet. Disclaimers should be calibrated so that a typical investor can understand the implications.
