I did my masters dissertation on this. Even Lord Justices of Appeal still make this mistake, and it can be seen in R v Belhaj-Farhat (2022). Phrasing is everything when using statistics in court.

My verbatim note taking from pupillage has really helped me in practice. If I’m not sure how to go about how to go about a certain topic in Chief or Cross, I often find I took a note of how to do it by watching someone else. Learning from others is crucial.

I once saw a Tweet that said being a lawyer is like being a surgeon except there is another surgeon in the room trying to kill your patient while you are trying to save them. I think about that alot.
